Agreement
These Terms are an agreement between you and SSMK Consulting LLC (“SongDuel,” “we,” or “us”). By creating an account or using SongDuel, you agree to these Terms and our Privacy Policy. If you do not agree, do not use SongDuel.
Eligibility and accounts
You must be legally able to accept these Terms and provide accurate account information. You are responsible for safeguarding access to your Apple ID, device, and SongDuel account and for activity performed through them.
SongDuel uses Sign in with Apple. You may not transfer your account, impersonate another person, or use the service if applicable law prohibits you from doing so.
Apple Music connection
SongDuel connects only to Apple Music. You must follow Apple’s terms and maintain any subscription required for Apple Music features. Catalog content, artwork, previews, playback, links, APIs, and availability are controlled by Apple and are not guaranteed by SongDuel.
SongDuel does not modify your existing Apple Music playlists. If you explicitly request it, SongDuel may create or refresh an app-owned Top 10 playlist based on your current ranking.
Your choices and content
You retain your rights in your personal ranking choices. You authorize SongDuel to process imported music metadata and ranking activity as needed to provide, secure, maintain, and improve the service. Music, artwork, provider marks, and related metadata belong to their respective owners.
You are responsible for content you choose to share from SongDuel and must not use the sharing features to violate another person’s rights.
Acceptable use
You may not misuse SongDuel, interfere with the service, attempt unauthorized access, bypass security controls, reverse engineer where prohibited, automate abusive requests, infringe intellectual-property rights, introduce malicious code, or use the service unlawfully.
We may investigate suspected misuse and may limit or suspend access when reasonably necessary to protect users, providers, or the service.
Availability and changes
SongDuel may add, change, suspend, or discontinue features. Rankings, movement, insights, previews, and statistics are provided for personal entertainment and may change as data syncs or ranking methods improve. We do not guarantee that the service or Apple Music integration will always be available or error-free.
SongDuel intellectual property
SongDuel software, branding, original interface elements, and documentation belong to SSMK Consulting LLC or its licensors and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the app as intended.
Disclaimers and limitation of liability
To the fullest extent permitted by law, SongDuel is provided “as is” and “as available,” without warranties of uninterrupted, error-free, or perfectly accurate operation. We disclaim implied warranties to the extent the law permits.
To the fullest extent permitted by law, SSMK Consulting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, or goodwill, arising from SongDuel. Nothing in these Terms limits rights or liability that cannot legally be limited.
Termination and general terms
You may stop using SongDuel or delete your account from Profile. We may suspend or terminate access for material violations, security threats, unlawful conduct, or risk to users or the service.
These Terms are governed by the laws of South Carolina, United States, excluding conflict-of-law rules and without overriding mandatory consumer protections in your place of residence. State and federal courts located in South Carolina will have jurisdiction unless applicable law requires another process. If one provision is unenforceable, the remaining provisions continue.
Changes and contact
We may update these Terms as SongDuel changes. Material updates will be reflected by the effective date above and, when appropriate, an in-app notice.
